Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Fandian hotel concierge platform ("Service"), operated by Fandian ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Description of Service

Fandian provides an AI-powered SMS concierge and staff task management platform for hotels. Hotel guests interact with the Service by sending text messages to a hotel's designated phone number. Hotel staff interact with the Service through a web-based admin dashboard.

2. SMS Messaging Program

By texting a hotel's Fandian number, guests opt in to receive SMS messages from that hotel via the Fandian platform. Message types include: AI-generated responses to guest requests, staff replies, and service confirmations.

  • Message frequency: Varies based on guest requests and hotel activity.

  • Message and data rates may apply depending on your mobile carrier plan.

  • To opt out: Reply STOP at any time. You will receive a confirmation and no further messages will be sent.

  • For help: Reply HELP or contact the hotel directly.

3. Hotel Operator Responsibilities

Hotels using the Fandian platform ("Hotel Operators") agree to:

  • Use the Service only for lawful guest communication purposes.

  • Not use the Service to send unsolicited marketing or spam messages.

  • Maintain accurate hotel information within the platform.

  • Ensure staff accounts are used only by authorized personnel.

  • Comply with all applicable laws and carrier regulations regarding SMS messaging.

4. Acceptable Use

You may not use the Service to:

  • Send fraudulent, harassing, or illegal content.

  • Impersonate any person or entity.

  • Interfere with or disrupt the Service or its infrastructure.

  • Attempt to gain unauthorized access to any part of the Service.

5. AI-Generated Responses

Some responses delivered through the Service are generated by artificial intelligence. While we strive for accuracy, AI responses may occasionally be incorrect or incomplete. Hotel Operators are responsible for ensuring the accuracy of information provided to the AI system, and for reviewing and correcting AI responses where necessary.

6. Availability

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, technical issues, or third-party service disruptions may occasionally affect availability.

7. Limitation of Liability

To the maximum extent permitted by law, Fandian shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service, including but not limited to loss of data, revenue, or guest satisfaction.

8. Termination

We reserve the right to suspend or terminate access to the Service for any Hotel Operator that violates these Terms or applicable law, with or without notice.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify Hotel Operators of material changes via email.

10. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
